⚠️ MANDATORY STARTUP AGREEMENT - READ CAREFULLY
- ▪ Uptime limits: We are a bootstrapped startup managed by a single developer (Senthil Kumar P). If the founder's physical development machine, server cabinets, or networks face local hacking, power outages, or hardware defects, we cannot guarantee 99% uptime. Uptime is best-effort.
- ▪ 50% Refund rule: If resource usage (builds compiled or pipeline minutes) exceeds 50% of your plan's monthly allocation, we cannot issue any refund for that billing cycle.
- ▪ Code leakage waiver: We use industry-standard encryption, hardware security modules, and isolation vaults. However, if code leakage or exposure occurs through zero-day vulnerabilities or hardware exploits, Senthil Kumar P and Venelx are not responsible or liable for any leakage, loss, or cloning of your code.
- ▪ No code liability: We are not responsible for the contents, errors, vulnerabilities, or failures of your compiled applications. Code security and functional correctness remain 100% your responsibility.
1. NO WARRANTIES ("AS IS")
VENELX AND THE COMPILING PIPELINES ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE CREATOR, SENTHIL KUMAR P, DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT BUILD CHIPS WILL BE BUG-FREE, ACCESS WILL BE SECURE, OR RUNNERS WILL BE CONTINUOUSLY AVAILABLE.
2. LIMITATION OF LIABILITY & DAMAGE CAP
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SENTHIL KUMAR P OR VENELX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, COMPILATION ARTIFACTS, SECRET TOKENS, OR CODE LEAKAGE, ARISING OUT OF OR IN CONNECTION WITH THIS SITE.
OUR MAXIMUM AGGREGATE LIABILITY FOR ALL CLAIMS OF ANY KIND SHALL BE STRICTLY LIMITED TO THE LESSER OF: (A) THE TOTAL AMOUNT YOU PAID TO VENELX IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) EXACTLY $10.00 USD.
3. INDEMNIFICATION CLAUSE
You agree to defend, indemnify, and hold harmless Senthil Kumar P, Venelx, and any related hosting entities against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising from your misuse of the platform, violation of these terms, or any security vulnerability, malware, or copyright breach inside your compiled codebase.
4. CODE OF CONDUCT & PENALTIES
All accounts must maintain the decorum of our code of conduct policy. Any probing, port scanning, payload fuzzing, or hacking of our systems without explicit legal, written consent from Senthil Kumar P is strictly prohibited. Violators will face immediate account termination, system IP blacklists, and maximum legal action under cybersecurity protection acts.
5. FORCE MAJEURE & DEVELOPER EMERGENCY
We are not liable for system delays or failures caused by events outside of our reasonable control. As a single-developer startup run by Senthil Kumar P, this includes hosting server outages, physical fiber line cuts, natural disasters, acts of government, and personal emergency, illness, or hospitalization of the sole developer.
6. GOVERNING LAW & ARBITRATION
These terms are governed by the laws of India, without regard to conflict of law principles. Any dispute arising out of these terms shall be settled exclusively through binding, individual arbitration in Chennai, Tamil Nadu, India. You explicitly waive your right to participate in class-action lawsuits or group arbitration.
